REGULATIONS ON ADMINISTRATION OF PREVENTION AND CONTROL OF POLLUTION TO THE MARINE ENVIRONMENT BY VESSELS has been approved by the Executive Meeting of the State Council on September 2, 2009. The Regulations will come into force as March 1, 2010.
A formal propaganda conference organized by Ministry of Communication (MOC) was held in Nanning, Guangxi province on Jan. 20th, 2010. More than one hundred delegates coming from State Council, MOC, MSA, coastal province government, oil companies, shipping companies, port companies, insurance companies, and oil spill response companies attended the seminar. The officer of Legislative Affairs Office of the State Council PRC unscrambled the articles of Regulation in details. However, some implementation rules were said under formulation by MOC and would come out later.

Chen Keyu attended the Forum held by Yangzi River Maritime Law Institute in Guilin
A Maritime Forum organized by Yangzi River Maritime Law Institute was held in Guilin on Nov. 27th, 2009. Around hundred delegates from river shipping companies, insurance companies, universities and law firms attended the event. The deputy master of Wuhan Maritime Court, Mr. Xu Shaolin chaired the forum. Chen Keyu was invited to give a speech on the topic of ship-source oil pollution prevention and claim issues.

Mr. Shi Depei Attended a Hatch Cover Testing Seminar
and Product Launch in Hong Kong on Nov. 6, 2009
A hatch cover testing seminar and product launch of Cygnus Hatch Sure jointly organised by Cygnus Instruments Ltd. and Andrew Moore & Associates Ltd. was held at the British Consulate Hong Kong on 6 November 2009.
As we know, hose testing of hold hatch covers is not feasible if the vessel is loaded with cargoes and during cold weather and may have some more restrictions and the hold hatch covers are to be tested using ultrasound equipment in accordance with the Club’s condition survey checklist. So we therefore believe the seminar will be of our surveyors’ great benefit due to the increasing importance of an effective hatch testing instrument.
Mr. Shi Depei from CMS Shanghai Branch was invited to attend the seminar and launch. He wrote a briefing and shared what he had learned after his return with the surveyors in CMS.

During Oct. 12th to Oct. 20th 2009, A delegation composed by the peoples from Ministry of Communication Academy of Transportation Sciences, MOC Waterborne Transportation Institute, MOC Transport Planning and Research Institute, and State Oceanic Administration (SOA) National Marine Environmental Monitoring Center visited USA and Canada. Chen Keyu and Kuang Shilin, being with the delegation, dropped in NOAA, Coast Guard R&D Center, ASA and Canada Ship-source of Oil Pollution Fund.
The visit is aiming at learning the mature experiences of corresponding organizations as the reference when China designs her own domestic ship-source oil pollution fund, as well as researches the implementation measures on the new promulgated Regulations on the Management of Prevention of Sea Environment Pollution from Vessel.

The Supreme Court visited CMS Shanghai Branch on Sep. 22, 2009
On behalf of the Supreme Court, Judge Feng Jinru from Guangzhou Maritime Court and Judge Wu Siying from Guangdong Province High Court visited CMS Shanghai Branch on Sept 22, 2009. During the three hours' meeting, Ms. Kuang Shilin introduced the business of CMS to the judges. The colleagues of consulting department, Zhang Jian, Amber Wang and Han Ke also attended the meeting and exchanged the ideas on hot spots of the laws and the judgements on marine pollution with the judges.

Shanghai International Maritime Forum 2009 was held
on September 15th and 16th, 2009
Shanghai International Maritime Forum 2009, hosted by China MSA and undertaken by Shanghai MSA, was held on September 15th and 16th, 2009 in Shanghai of China. "The Responsibilities and Challenges in Marine Environment Protection" was the topic of this forum.
Mr. Chen Keyu and Ms. Kuang Shilin from CMS were also invited to addend the forum, and on the second day’s workshop, Ms. Kuang gave a speech on the Compensation for the Damage from Marine Oil Pollution Incidents to the attendees from home and overseas.

The Sixth Maritime Seminar was held in Tengchong during July 5 to 8, 2009
The Sixth Maritime Seminar hosted by Huatai Insurance Agency & Consultant Service Ltd, was held in Tengchong of Yunnan Province during July 5 to 8, 2009. Mr. Gu Mingxiang from CMS was invited to attend the seminar together with attendees from Huatai, relevant P & I, lawyer agents, survey companies and so on.
Attendees discussed on the new shipping situation, which provides CMS the valuable information for our practice and promotion of service quality.

Chen Keyu gave a lecture on the seminar hosted by MSA Liaoning
Whereas the Bunker Convention came into effect in China
on March 9th, 2009 and the postponed deadline of purchasing oil liability
insurance for those coast-going ships (July 1st) is approaching, MSA Liaoning
province called in a seminar for local ship owners to introduce the background
of Convention, the damage/claim knowledge arising from the ship-resource oil
pollution accidents, and the procedure of how to get insured. Chen Keyu was
invited to attend the half-day seminar on June 5th and delivered a speech
focusing on the pollution impact and claim compensation. More than forty local
ship owners attended the seminar and appeared of interests on the service by
CMS.

An International Conference on Marine Pollution Liability and Policy was held
on June 4th and June 5th, 2009 in Dalian
An International Conference on Marine Pollution Liability and Policy (MPLP) organized by Dalian Maritime University in cooperation with Maastricht University (Netherland) was held on June 4th and June 5th, 2009 in Dalian, China.
The conference was aimed to provide new theoretical opinions for compensation and prevention of marine pollution and to offer guideline and suggestion for international convention and legislation of all the countries. The conference discussed on the issues of marine pollution liability and policy concerned by the whole world, such as criminal and civil liabilities concerning marine pollution.
Many officials and staff from China MSA, CRS, P&I Club and IOPC Fund, scholars and lawyers including Mr. Zhang Jian and Mr. Han Ke from CMS were invited to attend the conference. During the conference, the role of CMS and the Guideline on Ship Pollution Compensation in China published by CMS were introduced to some attendees.

GUIDANCE ON SHIP POLLUTION COMPENSATION IN CHINA compiled by China Marine Services Co., Ltd has been published in March, 2009. The Guidance will be published every two years. This first publication is about the summary of the existing regime and relevant laws and regulations and the introduction of the previous cases and experiences of CMS. For the purposes of providing some guidance for the domestic vessel-source pollution compensation as well as doing everything CMS could to provide a platform to facilitate information exchange between home and abroad, the Guidance centers on the issues of the compensation for vessel-source pollution, and chooses materials from the perspective of practicability, objectivity, comprehension.

The 7th board meeting
of CMS was held in Beijing on Mar. 14th, 2009
The 7th board meeting of China Marine Services Co., Ltd. was held at the meeting
room of CCS Mansion in Beijing on Mar. 14th, 2009. Directors were satisfied with
the company’s performance during the past two years and were very glad to accept
a dividend payoff. Also, directors approved the budget and business plan 2009
and expressed their concerns on business perspectives under current global
crisis. On the meeting, shareholders diversification was also discussed in
details, which was deemed as an approach to upgrade CMS’s independent status.
Mr. Sun Feng, the VP of CCS and the vice Chairman of CCSI, substituted Mr. Xie
Jinghua who was just absent from the office to attend the meeting.

CMS staff studies in
ITOPF as internship
In order to learn how ITOPF, the leading origination of international oil and
chemical spill response society, giving objective advices on clean-up measures,
environmental and economic effects, and compensation, CMS sent Mr. Zhang Jian to
study in ITOPF as internship from Feb. 7 to March 7, 2009. Another internship,
Mr. Dong Liyi, from China MSA joined the study at the same time. During the period of studying, ITOPF arranged a series of
presentations on oil response skills, fishery damages, wildlife Rehad, claim
assessments, environment damages, HNS response, and remote sensing, models and
GIS etc. Furthermore, ITOPF arranges the internships to visit relative
international organizations, oil spill response manufacturers, and authorities,
such as IMO, BMT, IPIECA, VIKOMA, and International Group P & I club. Mr. Zhang Jian also introduced the role of CMS, and gave a
presentation on the developments of oil spill response industry, to ITOPF.
