After the seminar in Qingdao in June, the Supreme Court convened another meeting in Beijing on the 26th September, for which only China MSA and CMS were invited to attend. The focus of the discussion relates to two particular issues in the forthcoming Judicial Interpretation of Laws in respect of Ship Oil Pollution. Firstly, what are good reasons, legally and socially, that the CLC/Bunker Convention shall apply to domestic trading vessels; secondly, does the strict liability principle under the CLC/Bunker Convention preclude victims from claiming direct compensation from the non-spill vessel? If yes, what would be legal and social consequences?
