The annual China Lawyers Maritime Law International Forum was held on the 24th and 25th November, 2012 in Shanghai. Judges, lawyers, people from P&I clubs, shipping industries and etc. all gathered together to discuss on a wide range of topics in respect of the maritime laws.
Ms. Kuang Shilin was invited by the organizer to speak on the legal issues relating to water pollution in China. During the discussion, opinions are exchanged, such as who shall be liable and can be sued by the claimant of the pollution damage in case of ship oil spill caused by the ships collision, the colliding vessel or the spilling vessel or both? What kind of claims with relation to clean up costs can be construed as cost and expenses "for rendering harmless of the ship" as described by the latest jurisdictional interpretation, and are therefore not subject to the limitation.
