After over a decade's effort, CMS has accumulated abundant experience in the assessment of pollution damage, and also teamed up a reservoir of both in-house and out-sourced expertise. As a recognized company in China, CMS was invited by China MSA to carry out a research program together with Shanghai Maritime University in 2010, and drafted the Guidance for Assessment and Compensation of Pollution Damages ("Guidance"), which is going to be one of the technical documents of the upcoming Chinese National Oil Pollution Fund ("Fund").
The Guidance not only stipulates the admissible claims of the Fund, the criterion of the admissibility, the procedure and principle of claim settlement, but also explains in details the assessment methods in handling claims of emergency response cost, the pollution control and clean-up cost, the loss of property, the loss of profit, the reasonable environment recovery cost, the related investigation cost and ect.
The Guidance is intended to be a practical guide for the applicants to present the claims properly against the Fund, and also for the staff or expert of the Fund to assess and compensate in a fair and unified manner for the claims.
